These “Terms and Conditions” apply to the sale of “Activities” and “Services” by Rock’n Jump Adventure SARL, with its registered office at 95 Route de Chez Dupont – 74570 Fillière, registered with the Annecy Registry on 14 March 2022 under SIRET number 91274550200019, to any natural or legal person, hereinafter referred to as the “Participant(s)/Customer(s)”.

Activities can be purchased either in person at the counter or online via the websites listed above.

The activity on offer is supervised by an instructor or guide who holds the relevant qualification, which is essential for teaching or supervising the activity. The supervisor works either as a self-employed person or as an employee.

The purchase of an Activity or Service sold by Rock’n Jump Adventure implies that you have read and fully accept these Terms and Conditions of Sale.

1 – Definition of the service

Rock’n Jump Adventure acts as a transparent intermediary between the Guide/Instructor and the Customer. It promotes and sells the Activities, and collects payments in the name and on behalf of the Guide/Instructor.

The Guide/Instructor provides supervision, facilitation, instruction or coaching in relation to the safety of the Activities on offer. They carry out their duties within the limits of their remit.

These General Terms and Conditions of Sale apply solely to the sale of activities and services provided by Rock’n Jump Adventure SARL, to the exclusion of any other transport, accommodation or catering services.

2 – Sale of the Business – Booking – Gift Voucher

To book an Activity or Service, or to purchase a Gift Voucher, the Customer must register online via one of Rock’n Jump Adventure SARL’s websites or that of one of its partners, and pay a deposit of 100% of the Service fee to confirm their booking or purchase.

Customers may also register at the reception desk at Place Saint Hubert – 39200 Saint Claude during opening hours.

For customers acting as legal entities, certain activities and services may be confirmed by quotation and paid for via a purchase order.

The Customer may be asked to provide specific information relating to the Activity at the time of booking.

Over-the-counter sales at the usual premises of Rock’n Jump Adventure Ltd. These General Terms and Conditions of Sale are displayed and freely available for consultation.

Online sales with online payment via the websites of Rock’n Jump Adventure SARL or its partners. Before any order is placed, Rock’n Jump Adventure SARL sets out the steps to be followed to conclude the contract and the means by which the Customer can identify any errors:

1/ The Customer checks the order details and the total price;
2/ The Customer confirms their order, accepts these General Terms and Conditions of Sale and pays for their order;
3/ Rock’n Jump Adventure SARL acknowledges receipt of the order and provides the Customer with confirmation of the contract on a durable medium.

3 – Right of withdrawal

The Customer is hereby informed that, in accordance with the provisions of Article L. 221-28 of the Consumer Code, registration for an Activity is binding and final, and that the Customer does not have a right of withdrawal.

4 – Prices – Additional charges – Payment terms – Complaints

The price covers the instructor’s fees and the operating costs of Rock’n Jump Adventure Ltd. It relates solely to the supervision of the Activity or Service, to the exclusion of any other services. It is inclusive of all charges (including VAT).

The price quoted is deemed to be the price of the Activity payable by each participant, unless Rock’n Jump Adventure SARL has specified that it is a total price for the Activity to be shared amongst all participants.

Any additional costs incurred in connection with transport, ski lifts, drinks, food, etc. shall be borne and paid directly by the Client(s), including those incurred by the Supervisor.

Payment terms: The full cost of the activity must be paid in advance, either in cash (at the counter only), by bank transfer or by credit/debit card (online via Stripe or at the reception desk via Monetico).

Legal entities will be able to pay for Services by purchase order via the Chorus Pro platform.

In the event of non-payment, a charge of 10% of the total invoice amount may be applied if the invoice remains unpaid 10 days after the date of issue, in addition to the statutory flat-rate compensation for recovery costs of €40.00. In the event of any dispute, the Commercial Court of Annecy shall have exclusive jurisdiction, unless otherwise provided for by law.

Complaints: Any complaints must be sent by registered post with acknowledgement of receipt to Rock’n Jump Adventure SARL no later than one month after the event giving rise to the complaint.

5 – Changes to or cancellation of the Activity

Mountain activities are subject to uncertainties relating to weather, snow and terrain conditions, visitor numbers, as well as the participants’ experience, technical skills and physical fitness.

To ensure the safety of people and property, the proposed activity may be cancelled or modified by Rock’n Jump Adventure Ltd at any time prior to, at the start of, or during the activity.

CANCELLATION BY THE CUSTOMER:
For half-day or full-day activities, all bookings are final and non-refundable.
For courses, trips, seminars or events, all bookings are final and non-refundable.

CANCELLATION BY THE ORGANISER:
Half-day or full-day activities, courses and trips, seminars or events may be cancelled if there are insufficient participants, or if conditions do not allow for the safety of participants to be guaranteed.
This applies up to two weeks before the start of your trips and courses, and up to the start of the activity for half-day or full-day activities, seminars and events. Activities paid for at the time of booking will then be refunded in full.

CHANGES TO THE PROGRAMME:
The locations listed in our promotional materials (websites, flyers, etc.) are provided for information purposes only. Depending on the participants’ ability levels, weather conditions, or for safety or operational reasons, we reserve the right to make changes to the programme. Under no circumstances will such changes give rise to a refund or compensation.

WITHDRAWAL BEFORE THE END OF THE ACTIVITY:
Customers who have commenced a half-day or full-day activity, a course or trip, a seminar or an event and wish to withdraw of their own accord shall not be entitled to a refund.

LATE ARRIVALS:
To ensure the Activity runs smoothly, the Customer undertakes to adhere to the agreed appointment times.
Failure by the Customer to keep to the agreed appointment time may result in the Activity being rescheduled or cancelled. In such cases, no refund will be given.

CANCELLATION INSURANCE:

The Customer may take out cancellation insurance at the time of booking. If the Customer does not take out cover at the time of booking, they have a period of 5 days to change their mind and take out cover. They must then contact Rock’n Jump Adventure Ltd to obtain the online application form.

Rock’n Jump Adventure Ltd offers Meetch insurance. Full details of the grounds for cancellation covered by the insurance and the refund conditions can be found on the Meetch website. Under no circumstances can the company be held liable for whether or not Meetch covers the cancellation.

6 – Technical and physical requirements – health

All customers must be ‘fit’ to take part in the activities for which they are signing up. If in doubt, they should consult a doctor.

The Customer must disclose any health issues, medical history, short-term or long-term treatment, or accidents that may affect their physical or mental health, as well as any specific concerns (such as vertigo, a history of accidents, fears, etc.).

Technical, physical or experience-related requirements may restrict the Customer’s access to the Activity.

Any Customer who falsely declares that they meet these requirements, and whose technical, physical or experiential level is lower than that declared, shall be fully liable for any and all consequences that may arise as a result.

7 – Equipment

Group equipment: The price includes group and safety equipment.

Personal equipment: The Customer must provide their own personal equipment. If this is not the case, a hire service is available. The Customer remains solely liable for any wear and tear, damage or loss of this equipment.

Equipment hire: The Customer may hire equipment. The Customer shall be solely liable for the use, wear and tear, damage or loss of such equipment.

The Customer is advised that they are solely responsible for their own property and for any damage that may result to them or to a third party, including to their vehicle left parked whilst the Service is being provided.

If personal equipment is worn out, Rock’n Jump Adventure Ltd or the instructor may require you to hire equipment.

The Instructor may be required to provide the Client with the technical and safety equipment necessary for the Activity. The Client undertakes to wear and use this equipment as intended throughout the Activity, unless otherwise expressly instructed by the Instructor.

In the event of abnormal use or wear and tear, breakage or loss of equipment loaned or hired to the Customer by Rock’n Jump Adventure Ltd, the Customer will be charged in accordance with the following scale:

  • Canyoning shoes and socks: €15.00;
  • Via ferrata gloves: €15.00;
  • Waterproof digital camera: €470.00;
  • Jumpsuit: €100.00;
  • Harness: €50.00;
  • Via ferrata harness: €90.00;
  • Helmet: €35.00;
  • Miscellaneous hardware (e.g. snap hooks, figure-of-eight knots, etc.): €10.00 per item.

8 – Responsibilities – Specific environment

The activities on offer take place in a specific mountain environment that involves objective and unpredictable natural hazards (rockfalls, flash floods, seracs, crevasses, avalanches, etc.). Supervision by a guide or instructor does not eliminate these natural hazards. Participants are aware of the dangers to which they are exposing themselves.

The Instructor is bound by a duty of care based on the means employed, rather than a guarantee of the outcome. They shall use all means at their disposal, including the option to cancel the activity, to ensure the participant’s safety with due care and diligence; the participant, however, retains an active role in carrying out the activity. The participant is responsible for their own safety and that of others. They must comply with safety and conduct rules based on common sense, as well as those provided by the Instructor.

9 – Insurance and Emergency Services

The instructors at Rock’n Jump Adventure SARL are covered by professional liability insurance in France and worldwide, which covers any damages resulting from their actions in a professional capacity, including search, rescue and repatriation costs.

This insurance does not replace the Customer’s personal liability for any damage they may cause to themselves or to third parties, or which may result from an external natural phenomenon.

It is the responsibility of the Customer(s) to take out personal liability insurance covering the booked Activity, including assistance, search and rescue, and repatriation.

The Supervisor informs the Client that they have the option of taking out annual or daily insurance, on the understanding that it is the Client’s responsibility to ensure that the required cover is in place.

What insurance cover is available for individuals taking part in sport?

Taking part in a sport on one’s own, that is to say as an individual, takes place outside the framework of a sports association or club. This includes, for example, the weekend jogger who makes the most of their weekend to run a few kilometres at a leisurely pace.

Good news: you are, of course, free to take part in this type of activity without necessarily having to take out insurance.

However, depending on the type of activities you undertake, whether on your own or under the supervision of a professional, please be aware that many sports are excluded from your standard insurance policies, particularly your personal liability cover (which is usually included as part of your comprehensive home insurance policy). Traditionally, activities considered ‘high-risk’ are excluded from this type of cover (air sports, climbing, mountaineering, mountain biking, motorised activities, diving, etc.).

Why take out insurance for your sporting activities?

The professional supervising you is insured in the event that they cause you harm, to cover the cost of emergency transport to the nearest medical facility. However, their insurance is not intended to cover the consequences of your own actions or the cost of repatriation from the hospital to your home, for example.

To protect yourself whilst taking part in sporting activities, you can take out specific sports insurance. This type of policy, available on an annual or daily basis, covers:

  • Civil Liability: If, whilst taking part in a sport, you injure someone through your own fault or negligence, in accordance with sections 1240 and 1241 of the Civil Code, you are civilly liable for having ‘caused harm to another person’;
  • If you injure yourself whilst taking part in a sporting activity, the Personal Accident (PA) insurance policy provides cover for serious accidental bodily injury and, where applicable, medical expenses, repatriation costs, search and rescue costs, and damage to sports equipment…

If your usual insurance company does not cover you for the reserved activity, you can look into the policies offered by the FFCAM, the FFME, the FFVL, Le Vieux Campeur, etc.

10 – Right to one’s own image

The Customer authorises Rock’n Jump Adventure SARL and the Instructor to use, without restriction, for promotional and commercial purposes, by means of reproduction, display, screening and adaptation, the images (photographs and videos) taken during the supervised Activity, unless the Customer expressly states otherwise prior to the start of the Activity.

The legal representative of the minor Customer grants Rock’n Jump Adventure SARL and the Supervisor permission to use images of the minor Customer under the same conditions.

11 – Reviews

Rock’n Jump Adventure Ltd may ask the Customer, by any means, to leave a review of the Service they have received, across various platforms (TripAdvisor, Facebook, Google, the website and any other platforms).

12 – Dispute resolution and applicable law

The Customer(s), Rock’n Jump Adventure SARL and the Supervisor shall endeavour to resolve any dispute amicably. Failing that, they shall have recourse, free of charge, to mediation through the Consumer Ombudsman in accordance with Article L.133-4 of the Consumer Code, whose contact details are as follows:

The language of reference for the settlement of any disputes is French. All disputes shall fall within the jurisdiction of the courts in the area where the registered office of Rock’n Jump Adventure SARL is located.
